The political left has chosen their strategy for preventing citizens from receiving the America First agenda they chose in the last election. They will bide their time, using activist judges to subvert the will of the people through judicial overreach, obstruction and delay.
Federal judges are sworn to apply the law as written, without passion or prejudice, yet many are deciding to abdicate their oath in favor of political advantage. Additionally, the Democrats have become quite skilled at forum shopping. This is the process of seeking out these activist judges who are willing to overstep their authority in order to help their political party. Lawsuits against the government are then brought in their courts, with a sympathetic outcome all but predetermined.
Though some Democrat judges have recently gone as far as harboring illegal immigrants and helping them elude law enforcement, their preferred weapon of choice has been something called a nationwide injunction. This occurs when a lower level judge decrees that his or her ruling applies not only to the plaintiff and defendant in their courtroom, but to everyone in the country, essentially making law from the bench. This is certainly an aberration of our judicial process and has been increasingly used in recent years as a tactic to prevent the federal government from enacting policy.
Nothing resembling a nationwide injunction appears anywhere in Article III of the Constitution, and it is clearly an usurpation of power that the SCOTUS will at some point need to address. It steals the sole power to make law from Congress, and it undermines the hierarchy of the Judicial branch, absconding the authority of the Supreme Court. It also magically delivers the judgement weight of a class action lawsuit, without demanding the plaintiffs meet the heavy requirements of one.
Over the last century, nationwide injunctions have been used by both parties to stymie the agenda of the President. However, the neutered Democrats have turned this rarely used desperation tactic into somewhat of a recreational sport. It is now their go-to tool of disruption against the Trump administration, and their shameless abuse of it illustrates vividly just how intolerant of democracy they have become. Numbers do not lie. There have been 127 injunctions issued since 1963. The Obama administration received 12. Biden had 14. In Trump’s first term, he received 64. Since Jan.20th of this year, he is already up to 15. Some of these have to do with Trump’s attempt to cut wasteful federal spending. Most, however, revolve around the topic of illegal immigration.
The Biden Administration allowed millions of illegal immigrants into the country in order to skew population numbers for House Rep apportionment. In addition, the intent of the Democrats is to give this highly government-dependent population voting rights in the near future. This is their strategy for survival, and the Democrats do not intend to let Trump foil their well-laid plan simply because he won some silly election. They intend to block every deportation they can, even for violent criminals. They intend to block any measure that improves election security, even voter ID, which 86% of Americans want. The Dems need illegal immigrants here, and they need them voting. Their future depends upon it. They lost the last election overwhelmingly and their approval rating has fallen to 25%. They have no control over the White House or Congress. The American voters took their power away, but instead of respecting the will of the people and letting this democracy game play out, the Democrats’ response has been to pop the ball.
It bears repeating that the Democrats are obsessed with power, and they do not care how they get it. As they have shown in previous lawfare campaigns, they will abuse any instrument at their disposal and shred the Constitution if need be. In their fatal conceit, they believe the American people are too inept to be trusted with freedom, and thus must be ruled by self-anointed coastal elites. In their twisted logic, they must trample democracy in order to save it.
The Democrat prioritization of the non-citizen is sometimes mistaken as just another mindless virtue signal by the left, but it is not. Make no mistake, it is an existential means of survival. If the SCOTUS does not act soon, these nationwide injunctions may just prove effective in keeping the illegal immigrants here, and keeping the Democrat party alive.
